Terms of Service

EnjinnX is an algorithmic Shopify OS 2.0 theme generator and Liquid conversion suite ("the Service") operated by EnjinnX ("we", "us", "our"). By creating an account or using the Service you ("you", "the user") agree to be bound by these Terms.

You must be at least 18 years old and legally capable of entering into a binding contract in your jurisdiction. If you are accepting these Terms on behalf of a company, you warrant that you have authority to bind that company.

You are responsible for keeping your credentials secure and for all activity that occurs under your account. Notify us immediately of any unauthorised access. We may suspend or terminate accounts engaged in activity that breaches these Terms.

You will not:

• Use the Service to generate content that is illegal, hateful, defamatory, sexually exploitative of minors, or designed to harass.
• Attempt to reverse-engineer, scrape, or extract system prompts, model weights, or proprietary internal logic of the engine.
• Resell, white-label, or re-host the Service or its outputs as your own SaaS product without a written commercial agreement.
• Use the Service to generate or distribute malware, phishing pages, or content designed to impersonate another brand without authorisation.
• Bypass rate limits, share single-seat credentials across multiple users, or use automation to inflate generation volume.

The Service calls third-party AI providers (Anthropic) on your behalf. Generation volume is capped at 200 engine generations per calendar month per seat on standard subscription tiers to keep upstream costs sustainable. Sustained usage beyond fair-use thresholds may be rate-limited or require an enterprise plan.

Programmatic usage (scripts, scrapers, browser automation) is not supported on standard plans. A separate API agreement is required for programmatic access.

Your output: You own the generated theme code, Liquid sections, and all outputs produced for you by the engine. We claim no ownership over what you generate.

Our service: The EnjinnX application, system prompts, niche benchmark registry, agent pipeline, brand, and all underlying source code remain our exclusive property. Your licence to use the Service is non-exclusive, non-transferable, and revocable.

Paid plans are billed monthly or annually in advance via Stripe. By subscribing you authorise recurring charges. You may cancel at any time from your account dashboard; cancellation takes effect at the end of the current billing period.

We aim for high availability but do not guarantee uninterrupted service. The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We may perform scheduled maintenance and will give reasonable notice where possible.

The Service depends on third parties including Anthropic (Claude API), Vercel (hosting), Stripe (billing), and Google Fonts. Their availability and policies are outside our control. If a dependency degrades or terminates, we will use reasonable efforts to substitute equivalent functionality but cannot guarantee parity.

To the maximum extent permitted by law, EnjinnX's total liability to you for any claim arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost revenue, or lost data.

You agree to indemnify and hold EnjinnX harmless from any claim, loss, or expense (including reasonable legal fees) arising from your misuse of the Service or breach of these Terms.

You may close your account at any time. We may suspend or terminate your access immediately for breach of these Terms, particularly Section 4 (Acceptable Use). On termination, your right to use the Service ends but provisions that by their nature should survive (IP, liability, indemnity) will continue.

We may update these Terms from time to time. Material changes will be notified by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

These Terms are governed by the laws of England and Wales, without regard to conflict of laws principles. Disputes will be resolved in the courts of that jurisdiction.
